The following terms and conditions apply to monthly payments payable to The London Transgender Clinic Ltd. where you pay your Fees to us by Direct Debit/Subscription Instruction.

These terms and conditions apply in addition to any terms and conditions specifically applying to (and accompanying) the treatment plan or service you have registered or purchased from us

IMPORTANT: Failure to pay your monthly payment plan will result in the cancellation of your monthly payment plan. You must pay your outstanding payment and will automatically be moved to our pre-payment plan, meaning you will have to pay upfront for any services rendered.

Please be aware that Subscriptions can fail due to expired cards, lost/stolen cards, and insufficient funds. It is essential that you inform us of any changes to your bank card immediately to avoid being moved to our pre-payment plan.

1. Definitions

1.1 In these terms the following words shall have the following meaning:
“Commencement Date” means the first day upon your services starting;
“Payment Instruction” means the completed instruction from you to your bank or building society authorising us to collect the Fees from your account in accordance with these terms and conditions;
“Fee” means the service fee we have agreed shall be payable monthly by you for use by you of our directed services;
“Year 1” means the first year of your hormone therapy service agreement; and
“Year 2” means the second year of your hormone therapy service agreement.

2. Our obligations to you

2.1 Our services include hormone therapy medical services. For which we shall charge you on a monthly basis, based on our agreement. We will notify you as soon as reasonably possible of any change in the amount of the Fee as and when applicable for example where you request additional services or where you renew services for an additional period of time. 3. Non-renewal or termination

3.1 If you choose to self-discharge from our services within the first three months of your first year of contract, a contract cancellation fee of £300 will be charged in one final transaction.

3.2 If you choose to self-discharge from the services, we provide at any time during Year 1 or Year 2 of the service agreement, you must maintain the Payment Instruction for the remainder of the given Year or pay the Fees due in one final transaction.

3.3 You agree that you shall not alter or cancel your Payment Instruction prior to our receipt of any monies due under this clause 3 of these Special Terms. 4. Payment Terms

4.1 Payments must be debited from a bank account associated with the individual receiving the services.

4.2 Payments will be debited from your account on the day that you sign up for our services and then will be collected on the same date our services commenced each month.

4.3 You agree to pay our fees via Direct Debit/Subscription. We will attempt to take payments via your issuing card/bank. In the event of non- payment, we shall move you to our pre-payment plan where you will have to pay upfront for services rendered. Please note that failure to attend follow up appointments will result in you being discharged from our services as it is not possible to provide safe care without assessing you 6 monthly.

4.4 We may on occasion need to increase charges for services provided by us at any time. If we need to increase our charges, we shall give you notice in writing promptly before the change is made

4.5 If any change in pricing is required, and this change is significantly higher than the rate you had paid previously and therefore not sustainable, we may (at our sole discretion) consider allowing you to terminate your service with us without penalty.

4.6 Any disputes arising regarding payment must be raised with us 21 days prior to the payment due date. If no dispute is raised within that period, we will collect payment on the agreed date.

5. Changes to Services

5.1 If the nature of a service changes, we shall notify you in writing of such changes as soon as reasonably possible.

6. Our Right to Cancel Services

6.1 If the service we have previously provided is no longer available for any reason, we are by extension unable to provide you with the service. If you fail to pay for the services we provide, we reserve the right to suspend or terminate your services with us until such amount outstanding is paid. If we have reason to believe that you have not provided accurate information for us to provide you with a safe service or illegally defame or utilise our services, we shall have the right to terminate our agreement. The grounds for us to terminate our agreement are included but not limited to the reasons above.

7. Contact

7.1 As part of our service, we shall allocate a telephone number and email address for your use. If such details should change, we shall provide you with notice as soon as possible of the pending change and shall allocate you a new number as soon as possible.

Data Protection
We are obliged to adhere to all data protection laws including (but not limited to,) the General Data Protection Regulation, the Data Protection Act 2018, and any other legislation in force from time to time.

Nothing within these terms shall override any express or implied terms set out in our main terms and conditions of service.

Contract Length

Contracts for the provision of our services are broken into Year 1 (12 months) and Year 2 (12 months). You agree that as part of this contract, you will receive and pay for services from us for a minimum of one year. See 3.3.1 for more information.

APPLICABLE LAW
These terms shall be construed with English law, any dispute arising shall be subject to the sole jurisdiction of the English Courts.
